Affiliate Program Terms and Conditions

1. Agreement

These Affiliate Program Terms and Conditions ("Agreement") govern participation in the Referral Momentum Affiliate Program ("Affiliate Program").

By applying for or participating in the Affiliate Program, you ("Affiliate") agree to be bound by these Terms and Conditions.

Referral Momentum reserves the right to modify these terms at any time. Continued participation in the Affiliate Program constitutes acceptance of any updates.

2. Affiliate Eligibility

To participate in the Affiliate Program, you must:

  • Be at least 18 years old.
  • Provide accurate registration information.
  • Maintain an active affiliate account.
  • Comply with all applicable laws and regulations.

Referral Momentum reserves the right to approve or reject any affiliate application at its sole discretion.

3. Affiliate Links and Coupon Codes

Approved affiliates will receive:

  • A unique affiliate tracking link.
  • One or more affiliate coupon codes (if applicable).
  • Access to affiliate reporting and performance data.

Affiliates may only use approved tracking links and promotional materials supplied or approved by Referral Momentum.

4. Commissions

Affiliate commissions are earned only when:

  • A new customer signs up using an affiliate tracking link or coupon code.
  • The customer successfully purchases a paid subscription.
  • Payment is successfully received by Referral Momentum.

Commission percentages, fixed bonuses, and payout structures are determined by Referral Momentum and may vary by affiliate.

Referral Momentum reserves the right to modify commission rates at any time upon notice to affiliates.

5. Recurring Commissions

Certain affiliates may be eligible for recurring commissions.

Recurring commissions will continue only while:

  • The referred customer maintains an active paid subscription.
  • The affiliate account remains in good standing.
  • The commission agreement remains active.

Recurring commissions immediately stop if the customer cancels, disputes payment, or becomes inactive.

6. Commission Reversals

Referral Momentum may reverse commissions in the event of:

  • Subscription cancellations.
  • Refunds.
  • Chargebacks.
  • Fraudulent transactions.
  • Duplicate accounts.
  • Self-referrals.
  • Abuse of promotional offers.

Referral Momentum reserves sole discretion in determining whether a commission qualifies for reversal.

7. Payout Schedule

Approved commissions will be paid according to the payout schedule established by Referral Momentum. Once an affiliate reaches $100 in commissions, payouts will be sent monthly.

Current payout methods may include:

  • PayPal
  • ACH Bank Transfer, or
  • 3rd party contracted party (such as Deel)

Referral Momentum may modify payout methods or schedules at any time.

Affiliates are responsible for providing accurate payment information.

8. Prohibited Activities

Affiliates may not:

  • Make false or misleading claims.
  • Misrepresent Referral Momentum products or services.
  • Bid on Referral Momentum trademarked terms in paid advertising without written permission.
  • Use spam, unsolicited email, or automated messaging.
  • Create fake accounts.
  • Refer themselves or create multiple accounts.
  • Engage in deceptive marketing practices.
  • Offer unauthorized discounts or incentives.

Violation of this section may result in immediate termination and forfeiture of unpaid commissions.

9. Intellectual Property

Referral Momentum grants affiliates a limited, revocable, non-exclusive license to use approved marketing materials solely for promoting Referral Momentum.

Affiliates may not:

  • Alter trademarks.
  • Modify logos without permission.
  • Represent themselves as employees or owners of Referral Momentum.

All intellectual property remains the exclusive property of Referral Momentum.

10. Affiliate Account Termination

Referral Momentum may suspend or terminate any affiliate account at any time for:

  • Violation of these Terms.
  • Fraudulent activity.
  • Abuse of the Affiliate Program.
  • Conduct harmful to Referral Momentum's reputation.

Upon termination:

  • Affiliate links may be deactivated.
  • Future commissions may cease.
  • Unpaid commissions may be withheld if fraud or abuse is suspected.

11. No Guaranteed Earnings

Referral Momentum makes no guarantees regarding:

  • Affiliate income.
  • Conversion rates.
  • Customer signups.
  • Revenue generated.

Affiliate results depend on numerous factors, including marketing efforts, audience quality, and market conditions.

Past performance does not guarantee future results.

12. Limitation of Liability

Referral Momentum shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from participation in the Affiliate Program.

Total liability shall not exceed the total commissions paid to the affiliate during the previous twelve (12) months.

13. Modification of the Program

Referral Momentum reserves the right to:

  • Modify commission structures.
  • Change payout schedules.
  • Change affiliate benefits.
  • Suspend or discontinue the Affiliate Program.

Reasonable notice will be provided when practical.

14. Independent Contractor Relationship

Affiliates are independent contractors.

Nothing in this Agreement creates:

  • Employment
  • Partnership
  • Joint venture
  • Agency relationship

between the Affiliate and Referral Momentum.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles.
